Mr. Alan Newton, 49, was released from prison in July 2006 having spent 20 years incarcerated for a crime he did not commit.  In 1985, Mr. Newton was convicted of rape, robbery and assault, based largely on eyewitness testimony.  He spent years fighting to have DNA evidence from the case located and tested.  Finally, in 2005, the rape kit from the case was found in a police department warehouse - about a decade after Mr. Newton and his lawyers had requested it. The testing showed that DNA collected from the victim did not match Mr. Newton.  On October 19th, 2010, a jury ruled that the city had violated Mr. Newton's constitutional rights, and found two police officers liable for intentional infliction of emotional distress for failing to produce the DNA evidence when requested. In this civil action against New York City, Mr. Newton was awarded 18.5 million dollars.
